These terms govern use of the website. Professional services are governed by the proposals, contracts and specific terms accepted for each engagement.

Nothing in this document limits mandatory rights established by applicable law.

1. Website operator

2. Purpose and scope

These Terms and Conditions govern access to, navigation of and use of the ZopiTech website, public content, forms and contact channels. They do not replace any proposal, quotation, purchase order, contract, annex, service-level agreement, licence, confidentiality agreement or specific terms entered into with a client. In the event of conflict, the applicable specific instrument will prevail.

3. Acceptance and authority

By accessing or using the website, you confirm that you have read and understood these terms. If you act for a company or organisation, you represent that you have sufficient authority to do so. If you do not agree, you must stop using the website. Browsing alone does not create a contractual, employment, partnership, agency or representative relationship with ZopiTech.

4. Informational nature and no automatic contract

Published information is general, indicative and informational. Descriptions of services, technologies, capabilities, case studies, timelines, results, prices or service levels do not by themselves constitute an irrevocable offer or contractual guarantee. Every engagement requires assessment, scope, conditions and express written acceptance. Submitting a form or message is only a contact request and does not imply automatic acceptance by ZopiTech; silence does not constitute acceptance.

5. Professional services and specific terms

Software development, integration, automation, data and analytics, cybersecurity, infrastructure, server administration, IoT, support and Staff Augmentation services are governed by the relevant contract or proposal. Such documents may address scope, deliverables, dependencies, intellectual property, licences, confidentiality, security, data processing, acceptance, warranties, support, fees and liabilities. Certain services may depend on third-party suppliers, platforms or licences subject to their own terms.

6. Permitted use

You may use the website only for lawful, informational and professional contact purposes. Information submitted must be accurate and interactions must be respectful. You may not use the website to violate rights, impersonate others, submit unlawful or malicious content, distribute malware, send spam, perform unauthorised automated extraction, bypass controls, disrupt operations, overload infrastructure or attempt to access restricted accounts, code, databases or services.

7. Administrative and restricted areas

Access to the administration panel, internal systems, dashboards, private APIs and other restricted areas is limited to expressly authorised users. Credentials are personal and confidential. Unauthorised access or attempted access may be blocked, logged, investigated and reported under applicable law.

ZopiTech applies reasonable measures to protect the website, but no internet-connected system can be considered completely secure or continuously available. Suspected vulnerabilities should be reported responsibly to [email protected] without exploiting them, accessing third-party data, disrupting services or publicly disclosing them before a reasonable opportunity for investigation and remediation.

9. Intellectual and industrial property

Unless otherwise stated, text, designs, interfaces, code, graphics, photographs, videos, documentation, trademarks, logos and other website elements are owned by ZopiTech or used under authorisation or licence. You receive only a limited, revocable, non-exclusive and non-transferable permission to view the website. Copying, modifying, distributing, selling, licensing, decompiling, commercially reusing or creating derivative works is prohibited without written authorisation, except where expressly permitted by law.

10. Third-party marks, client logos and business references

Third-party trademarks and logos remain the property of their respective owners. Their display is intended to identify clients, institutions, integrations, technologies or professional experience and does not transfer any rights. Display of a logo does not necessarily imply sponsorship, exclusivity or endorsement of every ZopiTech service. Certain references may be limited, generalised or anonymised for confidentiality reasons.

11. Case studies, metrics and outcomes

Case studies, metrics, percentages, benefits and outcomes describe specific experiences or scenarios and may be presented in summarised form. Results depend on scope, data, infrastructure, client participation, suppliers and operational context. They do not promise that another engagement will achieve identical outcomes.

12. Third-party links, integrations and services

The website may include links or references to external services, social networks, cloud platforms, tools, certificates, APIs or third-party websites. ZopiTech does not control their content, availability, security, policies or changes. Use of those resources is at the user's responsibility and their terms, licences and privacy policies should be reviewed.

13. Availability, continuity and website changes

ZopiTech may maintain, update, reorganise, suspend or withdraw all or part of the website, content or functionality for technical, commercial, legal or security reasons. Continuous, error-free availability or compatibility with every device and browser is not guaranteed. Where reasonable, ZopiTech will seek to minimise material disruption.

14. Accuracy and no professional advice

ZopiTech seeks to keep information clear and current, but errors, omissions or outdated content may occur. The website does not provide legal, tax, accounting, financial, employment or compliance advice and does not replace a specific technical assessment. Critical decisions should be made using appropriate professional advice and sufficient information.

15. Limitation of liability

To the extent permitted by applicable law, ZopiTech will not be liable for indirect loss, lost opportunities, data, profits or interruption arising solely from misuse of the website, temporary inability to access it or third-party services. Nothing in this clause excludes liability that cannot legally be limited or affects mandatory consumer or user rights.

16. Personal data and privacy

Personal data processing associated with the website is governed by the ZopiTech Privacy Policy and applicable law. You should not send sensitive data, trade secrets, credentials, access codes or confidential information through public forms unless requested by ZopiTech through an appropriate channel. The Privacy Policy complements these terms.

17. Cookies, technical logs and abuse prevention

ZopiTech may amend these terms to reflect legal, technological, security or website-operational changes. The effective version will be the one published on this page with its update date. Amendments apply from publication unless a later date is stated. Previously accepted contractual terms remain governed by the relevant specific document.

20. Severability and no waiver

If a provision is found invalid, unenforceable or ineffective, the remaining provisions will continue to apply to the extent legally possible. Failure by ZopiTech to exercise a right does not constitute a waiver. Headings are included only for ease of reading.

21. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Chile. Disputes relating to use of the website will be submitted to the competent ordinary courts of Santiago, Chile, without prejudice to mandatory rules, non-waivable rights and special jurisdiction provisions that may apply.
